Terms and Conditions
This website, www.thegembank.com, (the “Website”) is owned and operated by International Gemstones Limited, a company registered in England and Wales under the company number 05141720, with its registered premises at 39 Greville Street, London EC1N 8PJ, and VAT registered under reference number GB835479689.
You acknowledge that any use of the Website by you, including any transactions for which you use it, is subject to the Terms and Conditions set out below. This also includes our return, delivery and payment conditions (all conditions combined make up our “Terms and Conditions”). Please note that these Terms and Conditions also apply to any contract that you enter into with us by other means, such as telephone or email, for example when you view an item online and place an order directly.
Please read through these Terms and Conditions carefully, as your use of the Website will signify your agreement to be bound by them.
We reserve the right to amend these Terms and Conditions at any time. Any such amendments will become effective as soon as they are published on the Website. Your continued use of the Website signifies that you agree to the latest version of our Terms and Conditions. Any purchases made are based on the version of the Terms and Conditions published at the time of purchase.
Product Availability and Pricing
Due to the multiple sales channels offered by The Gem Bank, sometimes an item can become out of stock before we are able to publish an updated product listing on the Website. Should this happen, we will notify you personally and offer you, as an alternative, a different product that is similar, or almost identical in grading to the original product. You will also have the option to cancel your order, if you do not find any of the alternatives to be suitable.
While we make every effort to display our products to the best degree of accuracy, it is possible that data may be erroneously displayed due to a system or typographical error. While we make every attempt to minimise the occurrence of such errors, we cannot guarantee that they will not occur. We reserve the right to correct any errors as they occur and we do not honour sales based on inaccurate or erroneous information. Should the listed price be lower than its actual price, we will attempt to contact you before shipping the product and then, based on your instructions, we will either cancel the order, or charge you the revised amount.
The Gem Bank’s prices are also subject to change without prior notice. We apologise for any inconvenience this may cause; our prices are affected by the worldwide supply and demand of precious metals and gems and changes are often abrupt and unexpected.
We pride ourselves on the quality of our products and our value for money. For most products, the price that you see on our website is the lowest possible price we can offer, and are therefore final and not open to negotiation. This does not preclude us from offering special promotions to reward loyal or returning customers.
Responsible Sourcing and Making
Learn more about our responsible sourcing and making policy here.
Sales Tax/VAT
Value Added Tax (VAT) of 20% will automatically be added to all UK sales. For customers outside of the UK, all orders are shipped with Import Duties and Taxes unpaid. Customers will be contacted by our nominated courier in advance of delivery for collection of these fees which are payable directly to the courier. Duties and taxes are non-refundable.
Payment Order Receipt
The Gem Bank must receive payment in full before your order can be accepted, and any items remain the property of The Gem Bank until full payment has been received and cleared. The Gem Bank reserves the right to refuse to supply to any person for whatever reason.
Delivery and Insurance
If no prior agreement is made for local collection, all of our shipments are fully insured and sent via Royal Mail Special Delivery Postage (UK orders up to £2,500), via FedEx or UPS (worldwide up to £30,000), or a specialised jewellery courier (Malca-Amit) for items over £30,000. This insurance protects your order from the time it leaves us, to the moment that it arrives at your provided address.
For added security, we may request confirmation of your identity before shipping your order, and a signature will be required upon delivery of your purchase. It is important that you provide us with accurate information, otherwise our identity checks could produce negative results, that may result in your order being delayed or cancelled. To protect against theft, we recommend that you provide a delivery address that is not accessible to third parties.
You will be notified when your goods have been dispatched; where delivery times and dates are provided, they are for general guidance only and we will not be held liable for late delivery of goods caused by circumstances outside of our reasonable control. You must inform us at gems@thegembank.com within 3 working days if your order has not been received.
Please make arrangements to be available at the shipping destination to sign off after receiving your order. We accept no liability for loss, consequential or other, where the terms and conditions of the carrier are not met.
We can deliver your order to an address other than your billing address if this is more convenient for you. However, as a security precaution, we require that your alternative shipping address is registered with your credit card company, or a recognised form of identification registered at this address is provided and verified. This protects The Gem Bank and our customers from fraudulent charges to your credit card.
Customer Responsibility
The Gem Bank cannot guarantee that the sale and delivery of goods to your particular country or location is permissible, so please be aware of your own geographic import restrictions. This site and its contents will not constitute the basis for any contractual commitment between The Gem Bank and any prospective customer in any jurisdiction where the solicitation of interest of the offering of or sale of products by The Gem Bank would contravene any applicable local, regional or national legislation. No prospective customer should seek to make any order through the site from jurisdictions in which it would be illegal for The Gem Bank to sell products.
Gemstone Grading Certificates
Where one is indicated in its listing, all relevant gemstones will be provided with a grading report. As per industry standards, no stones below 0.20 carats are provided with a grading certificate.
